3.1 Digital Products

When you purchase a digital product from us, you are granted a limited, non-exclusive, non-transferable license to use the product according to the terms specified at the time of purchase.

3.2 Physical Products

Physical products, including prints and merchandise, remain our property until full payment has been received. Title and risk of loss pass to you upon delivery.

3.3 Pricing

All prices are in British Pounds (GBP) unless otherwise stated. We reserve the right to change prices at any time without prior notice. Prices are subject to applicable taxes and fees.

4. Orders and Payment

4.1 Order Acceptance

Your order constitutes an offer to purchase our products. We reserve the right to accept or decline any order for any reason. We may require additional verification or information before accepting any order.

4.2 Payment Processing

Payment is processed securely through our payment provider. We do not store credit card details. You agree to provide current, complete and accurate purchase and account information for all purchases.

4.3 Order Confirmation

You will receive an email confirmation once your order has been placed. This does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

5. Delivery and Shipping

5.1 Digital Delivery

Digital products will be made available for download immediately upon successful payment. You are responsible for downloading and storing your digital products.

5.2 Physical Delivery

Physical products will be shipped to the address you provide. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by shipping carriers or customs.

5.3 Shipping Costs

Shipping costs will be calculated and displayed at checkout. International orders may be subject to import duties and taxes, which are the responsibility of the customer.

6. Returns and Refunds

6.1 Digital Products

Due to the nature of digital products, all sales are final. Refunds will only be provided in exceptional circumstances at our sole discretion.

6.2 Physical Products

You have the right to cancel your order within 14 days of receipt without giving any reason. Products must be returned in their original condition. Return shipping costs are the responsibility of the customer unless the product is faulty.

6.3 Damaged or Faulty Items

If you receive a damaged or faulty item, please contact us within 7 days of receipt with photographic evidence. We will arrange for a replacement or full refund including return shipping costs.

7. User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password.

You agree to accept responsibility for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

By submitting content to our guest book or product reviews, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content on our website and marketing materials.

If you participate in a photo session, you may be required to sign a model release form. This grants us permission to use your images for specified purposes as outlined in the release form.

11. Limitation of Liability

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

You agree to defend, indemnify and hold harmless Immortal by Nige and its employees, contractors, agents, officers and directors from any claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your violation of these Terms.
